To help your clients and do our part to help to keep these businesses running, we are temporarily adjusting our coverages for both restaurant commercial clients and restaurant employees who have auto coverage with us. Personal auto temporary food service coverage extension
We’re temporarily suspending the enforcement of the food delivery exclusion for restaurant employees to address delivery-related gaps.
As states have increasingly adopted restaurant seating bans, many restaurants have shifted to take-out or delivery-only service and are asking their employees to take on new responsibilities to deliver food. In certain circumstances, those employees are using their personal vehicles for this commercial purpose. Depending on the state and product, Integrity's current Personal Auto insurance contracts may exclude coverage for food delivery.
In states that have issued, or may issue in the future, emergency declarations and/or executive orders to clarify the application of coverage for restaurant delivery services, Integrity will settle claims based upon the direction of the state insurance regulators for the duration that those state guidelines are in effect.
For all other states that do not have emergency declarations and/or executive orders in effect, Integrity will not enforce the exclusion on personal auto policies for restaurant employees delivering food in their listed vehicles on behalf of their restaurant employers that have been impacted by COVID-19 restrictions. This change is effective March 20, 2020, through the period in which each restaurant is subject to a mandate to cease on-premises dining operations by the civil authorities in their locations, up to a maximum of 90 days after this communication.
This extension of coverage does not apply to:
- Any food delivery through a Transportation Network Company or similar delivery service that provides food-ordering and delivery, including but not limited to Grubhub, Uber Eats, DoorDash or Seamless
- Any employee who delivered food (part or full time) for the restaurant prior to March 20, 2020
- Any Personal Umbrella policy extending above the Personal Auto policy
This temporary extension of coverage does not stack with any other coverage that is currently afforded to the policyholder or operator of the vehicle.
This temporary extension of coverage is not afforded to drivers who otherwise have coverage for deliveries through their commercial policy or another policy.
All other terms, conditions, coverages and limits stated on the declarations page and policy documents continue to apply. We will continue to monitor this situation and determine the need to extend or adjust our position.
Our temporary suspension of this food delivery exclusion will expire effective 11:59 p.m. EDT on June 30, 2020*. Wisconsin resident suspension will expire effective 11:59 p.m. EDT on July 4, 2020.
